Trust is very important in partnership business but sometimes there is need to have a properly documented agreement signed by both parties. Partnership business involves more of agreement than trust. A signed agreement by both parties will go long way to preserve a partnership business.
In what way you don't trust him? I have few people who I don't trust personaly and those are not even my friends, just people who I know. If we look at business side, those people can be good partners if you know they are very proffesional and different in business. You can be good business partner but bad 'friend'.
For me, it's not possible to go into partnership business with someone I do not trust. As a matter of fact, I will not call him/her my friend. Without trust and honesty, shared goals and values, the partnership will not succeed.
How could someone transact with someone you don't trust? It will be very impossible. There might be danger going on. That person plays havoc to your business. There might be silent motive or a hidden agenda to be done by that person.

Probably, going into a business with someone you do not trust is actually not a good idea. But if someone decides to do so then they should sign everything legally.
